We are committed to protecting your privacy. This policy (together with the Terms and Conditions) explains how we will process, use or share any personal data it collects from you, or that you provide to us. By visiting and using the Cronycle website, any associated digital app which we may release from time to time, and any related properties (“the Service”), you are accepting and consenting to this Privacy and Cookies Policy (the “Policy”). We may, from time to time, make changes to this Policy and these will be posted on this page. Please check back frequently to see any updates or changes to the Policy.

For the purposes of the Data Protection Act 1998 (the “Act”), we are the data controller and will only use the information that we collect about you lawfully (in accordance with the Act).

Please read this Policy in conjunction with the Terms and Conditions. Any capitalised terms used in this Policy shall have the meanings given to them in the Terms and Conditions.

The Service may, from time to time, contain links to and from third party websites and properties. If you follow a link to any of these websites or properties, please note that these websites and properties have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites and properties.

1. Information Cronycle may collect

We may collect and process information about you when you use the Service. In particular, this may include information you give us by filling in forms on the Service or by corresponding with us, including when you register to use the Service, download the Cronycle app, or link or associate your account to and with the account you hold with a third party service. The information you give us may include your name, address, e-mail address, phone number, and personal description. For Premium Service Users, all credit card information is submitted to our payment processor partners and we do not see or keep these details.

We may also automatically collect technical information, including your IP address and information about your visit to the Service (and how you use the Service), such as content you viewed or searched for and page and feed interaction information. We also work closely with third parties (such as sub-contractors in payment and delivery services) in order to give you the best experience possible and we may receive information about you from them.

To access certain functions of the Service, you may need to link and associate your Cronycle account to your valid account with certain third party services (such as Twitter). We may receive information from such services when you link your account with them to your Cronycle account, such as your name, email address, gender, locale, and other information in your public profile. You can manage the disclosure of this information through your account with the third party service. You agree to comply with all of the third parties’ terms of use and privacy policies when accessing the third party service through your Cronycle account.

2. Using your information

Where you purchase a subscription to the Premium Service, we will use your information for the performance of that purchase. This may include disclosing your information to our payment processing partners and any sub-contractors necessary for the processing and performance of your purchase.

We may use the information you provide and the information we receive from third parties to carry out our obligations and to provide you with the information, content, services and products that you request from us and to provide you with information about other content, goods and services which we feel may interest you. We will usually inform you (before collecting your data) if we intend to use your data for marketing purposes or if we intend to disclose your information to third parties for such purposes. You have the right to ask us not to process your personal data for marketing purposes and you will have the opportunity to refuse any such marketing correspondence from us or third parties by checking certain boxes on the forms we use to collect your personal data. We may use your email address or mobile number, without further consent, for administrative communications such as notifying you of Service updates, for customer service purposes, and to send privacy or security related notices.

We use all of the information that we collect to understand the usage trends and preferences of our Users, to improve the way the Service works and looks and to create new features and functionality.

We may additionally use your information in order to validate you as a registered User, tell you about changes to the services we provide or changes to our Terms and Conditions and Policy, to deliver the Service to you, to allow you to upload, share and store content, to moderate your account and your User Content, to detect and prevent criminal or infringing activity, and to comply with applicable laws.

We may also use the information we collect about you to administer and improve the Service. Although the Service currently features no advertising, to the extent that it does so in the future, we may also use information we collect about you to measure or understand the effectiveness of such advertising, and to deliver personalised services and relevant or targeted advertising to you.

By using the Service, you agree that we may (but are not obliged to) moderate the content you share to ensure it complies with this Policy and the Terms and Conditions.

We will not keep your personal information for longer than necessary for our operational purposes or for compliance with applicable laws.

3. Disclosing your information

We may disclose your personal information to third parties in the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer, or where we are under a duty to do so in order to comply with any legal obligation, or in order to enforce or apply the Terms and Conditions and other agreements or to protect our Users or others.

We may also share your information with selected third parties including business partners such as suppliers and sub-contractors for the performance of any contract we enter into with them or you or the performance of any order or purchase you place through the Service. We may disclose some limited user information to affiliated companies or other businesses or persons to: provide website hosting, maintenance, and security services; conduct data analysis and create reports; offer certain functionality; and assist us in improving the Service and creating new services features. We contractually require that these parties process such information in compliance with this Policy, we authorise only a limited use of such information, and we require these parties to use reasonable confidentiality measures.

We may disclose user information if required to do so by law or in the good-faith belief that such action is necessary to comply with laws (such as copyright or trade mark law) or respond to a court order, or warrant in the manner required by the requesting entity.

We will cooperate with all law enforcement enquiries and third parties to enforce their intellectual property or other rights. We may also access and disclose your personal information and content to government or law enforcement agencies or courts as required by law or, in our sole discretion, when we believe that disclosure is necessary to protect ourselves, you, other Users or any third parties.

We also reserve the right to disclose user information that we believe, in good faith, is appropriate or necessary to take precautions against liability; enforce our Terms and Conditions and Policy; protect us from fraudulent, abusive, or unlawful uses; to investigate and defend ourselves against third-party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Service; or to protect the rights, property, or personal safety of Cronycle, our Users, or others.

4. Information you share with other Users

You may voluntarily share information, data and other content with other users via the Service. Please be careful about disclosing any information or content that includes sensitive details about you such as your religious beliefs, sexual orientation, ethnic background and health details. While you may voluntarily upload information of this type, please be aware that any content you post via the Service may reveal these kinds of sensitive personal data to other Users (and the public at large). Where you do upload information and content of this nature, you are explicitly consenting to us processing this information and making it available to other Users. When you share information or content on the Service, the amount of personal information you share about yourself or others is at your own risk. When you upload or share content that features or includes another person, or when you provide information about other people, you are solely responsible for obtaining their prior consent for you to do so and for telling them that we may use such content and any personal information about them which you provide in accordance with this Policy.

The Service provides you with the option of making your personal Cronycle feed on the Service accessible to the public. The default setting on sign-up is for feeds to be private, and so please only change this setting if you are happy for your feed and all the content on it to be accessible by others (including the general public).

5. Our commitment to children’s privacy

Protecting the privacy of young children is especially important. For that reason, we do not knowingly collect or maintain personally identifiable information from persons under 13 years-of-age.  If we learn that personally-identifiable information of persons less than 13-years-of-age has been collected on or through the Service, then we will take the appropriate steps to delete this information.

If you are the parent or legal guardian of a child under 13 who has become a registered User, then please contact us at [email protected] to have that child’s account terminated and information deleted.

6. Storing your information

The data and information that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA“). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the fulfilment of your subscription purchases, the hosting of your content, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy.

Where we provide you (or where you have chosen) a password which enables you to access certain parts of the Service, you are responsible for keeping this password confidential. Please do not share a password with anyone. We similarly recommend you take great care when choosing your username as it may reveal personal information about you. This information may be available to the general public.

We use commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information.  Unfortunately, the transmission of information via the internet is not completely secure. We cannot ensure or warrant the security of any information you transmit to the Service, and you do so at your own risk. Once we receive your transmission of information, we make commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If we learn of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. We may post a notice on the Service if a security breach occurs.

8. Cookies

The Service uses cookies to distinguish you from other Users of the Service and to improve your overall experience. When you use the Service, certain information may be stored locally on your device using ‘cookies’ or similar technologies such as objects stored in the device’s local storage. A cookie is a small text file used to store limited information about the user of the device. They help us to identify how Users use the Service, and so that we can continue to develop and improve it.

Cookies do this by storing information about your preferences on your device, including the device model, manufacturer, screen resolution, device capabilities, service provider, country and city location data.

We access this information when you use the Service, to provide you with content, and for reporting and analytics purposes.
